In accordance with the law of the Russian Federation "On Environmental Protection", when designing, building, reconstructing, operating and decommissioning enterprises, buildings and structures in industry, agriculture, transport, energy and housing and communal services, measures must be taken to environmental protection, rational use and reproduction of natural resources, as well as the requirements for environmental safety of the designed facilities and protection of public health. In accordance with the requirements of the "Instructions on the procedure for the development, approval, approval and composition of design documentation for the construction of enterprises, buildings and structures", SNiP 11 - 01 - 95, a section "Environmental Protection" should be developed as part of design documentation for the construction of objects for various purposes (OOS).

The section of the project is developed on the basis of an approved feasibility study for construction, schemes and projects of the regional planning of cities and towns, schemes of master plans for industrial facilities, taking into account the requirements of territorial schemes for nature protection, basin schemes for the integrated use and protection of water resources, as well as engineering and environmental materials surveys carried out for the preparation of the project.

When developing it for the designed object, you should do the following:

Assessment of the current state of the natural environment and the level of technogenic load in the area where the facility is located (including alternative sites);

Determining the level of impact of the object on the environment for various options for the implementation of the project;

Assessment of changes in natural environments as a result of the planned impact;

Assessment of the consequences of the object's impact on the environment, social and economic conditions of life of the population;

Definition (calculation) of environmental damage;

Development of measures to prevent or reduce possible adverse impacts on the environment according to the main options for decisions made and assess their effectiveness and sufficiency;

Development of measures to organize monitoring of the state of the environment.

All major decisions on environmental protection during the construction and operation of facilities for various purposes, as well as the complex of environmental protection measures applied, must be determined when developing the investment justification. When developing project documentation, these solutions can be supplemented and refined. The section "Environmental Protection" as part of the project documentation should contain a set of proposals for the rational use of natural resources in construction and technical solutions to prevent the negative impact of the designed facility on the environment. The composition and content of the section may be specified in relation to the requirements of the specifics of the design of enterprises in the relevant industries or the parameters of housing and civil facilities.


The section "Environmental Protection" as part of the project documentation should contain a set of proposals for the rational use of natural resources in construction and technical solutions to prevent the negative impact of the designed facility on the environment. The composition and content of the section may be specified in relation to the requirements of the specifics of the design of enterprises in the relevant industries or the parameters of housing and civil facilities.

The section "Environmental protection" in the project documentation should contain the following main subsections:

Brief information about the projected object;

Protection and rational use of land resources;

Protection of atmospheric air from pollution;

Protection of surface and underground waters from depletion and pollution;

Environmental protection during storage (utilization) of production waste;

Protection of flora and fauna;

Forecast of changes in the state of the environment under the influence of the projected object;

Ecological and economic efficiency of construction, reconstruction, technical re-equipment of the facility.

When developing the "Environmental Protection" section, they are guided by a list of regulatory documents approved for use by a specially authorized body in the field of environmental protection of the Russian Federation. An approximate list of documents is given in Appendix 1 of the Manual to SNiP 11-01-95. In view of the fact that the general requirements for environmental protection for the facility being designed were considered at the pre-project stage, when justifying investments in the project documentation section, it is necessary to compare the data of the justification with the parameters adopted in the project documentation. In the event that there are significant discrepancies in environmental characteristics, it is necessary to identify the causes that caused the discrepancy and ensure that the necessary measures for the protection of the environment are carried out.

When developing the section "Environmental Protection" as part of the project documentation, the following should be identified:

Existing natural and climatic characteristics of the area where the facility is located;

Types, main sources and intensity of the existing technogenic impact in the area under consideration (volume of emissions and discharges, pollution of the territory and soil, landscape disturbance, etc.);

The nature of the use and volume (quantity) of natural resources involved in economic turnover, the conditions for their transportation to the projected facility;

The nature, volume and intensity of the expected impact of the projected facility on the air environment and the territory during construction and operation;

The amount of production waste, the degree of their toxicity, conditions of storage, burial or disposal;

The possibility of using waste in other industries and in other sectors of the economy;

The possibility of emergency situations at the facility and their consequences;

Changes in environmental parameters under the influence of the designed object (proposed economic activity);

Environmental and social consequences of the construction and operation of the facility.

The section "Environmental Protection" should contain the natural and climatic characteristics of the area where the facility is located, the types and sources of the existing technogenic impact in the area under consideration, the nature and intensity of the projected facility's impact on environmental components during construction and operation, the amount of natural resources involved in economic turnover, the amount of production waste generated and the possibility of their use in other industries, an assessment of the nature of possible emergencies and their consequences.

For all forms of impact of the object in the section "Environmental Protection" design solutions must be selected to neutralize or reduce the negative impact of the object on the environment. At the same time, it is necessary to justify and select the best technical solutions that ensure the prevention or reduction of emissions into the atmosphere, the aquatic environment, and reduce the amount and toxicity of waste.

In the section "Environmental Protection" there is no need to duplicate all the materials on the decisions made, developed in other sections of the project documentation and aimed at reducing or eliminating the negative impact of the facility on the environment. The amount of materials provided should be sufficient to evaluate the effectiveness of the decisions made and ensure environmental protection from the negative impact of the facility.

The materials of the section should contain conclusions on the compliance of the adopted design decisions with the existing environmental legislation and the rational use of natural resources, confirm the environmental safety of the planned activity /10/.

The rationale for technical solutions for environmental protection should be supported by calculations of the environmental and economic efficiency of the applied environmental measures. When determining the effectiveness, one should compare the costs of implementing environmental protection measures with the amount of prevented economic damage detected for all components of the natural environment.

In the "Environmental Protection" section of project documentation, a forecast of changes in the state of the natural environment and socio-economic living conditions of the population in the area where the facility is located should be developed.

Consider the composition of the design documentation for the subsections of the project.

1. Brief information about the designed object.

General information about the facility being designed is given in the form of a table, which provides the building area, production characteristics, names of industries and technological processes, volumes of resource consumption by construction phases and for the full development of the enterprise. The parameters and characteristics of the impact of the projected object on the environment, established at the stage of investment justification, are given. Many parameters and characteristics of the location area and the projected facility itself, determined at the investment justification stage, are used in the development of project documentation without changes. In cases where the production capacity of the facility changes during the design, new, more advanced equipment is used, or a technology is used to manufacture products that differs from that adopted in the justification, all characteristics and parameters of the facility's impact on the environment require clarification and addition.

2. Protection and rational use of land resources.

Construction objects always affect the territory and the geological environment. Their impact is expressed in the alienation of land for the location of the object, changes in the relief, an increase in the load on the foundation soils from the weight of various structures, changes in hydrogeological characteristics and surface runoff conditions. When developing design documentation, the characteristics of the land plot should be given: engineering and geological conditions, hydrogeological conditions, characteristics of hazardous exogenous processes, soil conditions of the territory, and the nature of land use.

Characteristics of the land plot and the adjacent territory, engineering and geological conditions:

The site is free from development, located on a small peninsula slightly protruding into the reservoir. The site is washed from the northwestern and northeastern parts, 200 - 500 m from the coast. Introduction

The problems of environmental protection and rational nature management cannot be solved without a permanent mechanism for preventing, localizing and eliminating negative anthropogenic impacts from planned and ongoing activities, as well as their consequences.

One of the elements of such a mechanism is a comprehensive assessment of the state of the environment, the development of environmental and resource-reproducing measures in urban planning and other project documentation, the environmental justification of economic activity at the initial stage of making economic, social, urban planning and other management decisions.

This Instruction on the procedure for the development and composition of the "Environmental Protection" section in urban planning documentation in Moscow (hereinafter referred to as the Instruction) regulates the general requirements for the development, composition and design of the "Environmental Protection" section in urban planning documentation in Moscow in accordance with legislative acts of the Russian Federation and Moscow on issues of urban planning, resource use, environmental protection and sanitary and epidemiological welfare of the population.

The instruction is intended for use by design and research organizations in the preparation of technical specifications and the development of relevant sections of urban planning documentation, for city and territorial (district, district, etc.) committees for nature protection, local governments, customers of investment activities.

1. General Provisions

1.1. This Instruction is the main regulatory document containing information available in legislative acts, regulatory technical and methodological documentation, as well as in the scientific literature on the composition of research, survey and design work necessary for the development of the "Environmental Protection" section for all types of urban planning documentation.

The instruction regulates the composition and procedure for the development of the "Environmental Protection" section at various stages of urban planning.

The requirements of the Instruction are mandatory for all organizations and institutions in Moscow, regardless of their form of ownership and types of economic activity, which are developers and customers of urban planning documentation in accordance with the legislation of the Russian Federation.

1.2. The instruction was developed on the basis of the provisions of the Law of the Russian Federation "On the fundamentals of urban planning in the Russian Federation", the Law of the Russian Federation "On the protection of the natural environment", the Law of the Russian Federation "On the sanitary and epidemiological welfare of the population", the Law of the Russian Federation "On investment activities in the Russian Federation", the Law of the Russian Federation " On specially protected natural areas", Regulations "On the status and management structure of the city of Moscow - the capital of the Russian Federation", the Charter of the city of Moscow, as well as other laws of the Russian Federation, acts of the President of the Russian Federation, the Government of the Russian Federation, State bodies of the Russian Federation and the Government of the city of Moscow. The composition and requirements for the development of these types of documentation are given in sections 2-13 of the Instruction.

1.5. The customers of urban planning documentation and, accordingly, the section "Environmental Protection" (hereinafter referred to as the "EP") as part of the project are state authorities and administrations, local governments, organizations, institutions and other legal entities (in accordance with Article 7 of the Law of the Russian Federation "On the fundamentals of urban planning in the Russian Federation").

1.6. The implementation of the work provided for by the Instructions on the development of the "Environmental Protection" section at various stages of urban planning is carried out by developers of urban planning documentation who have a license in accordance with the procedure for licensing this type of work in Moscow.

Design organizations of urban planning profile, performing the main scope of work, have the right to attract specialized design, survey, research and other organizations dealing with environmental problems and having licenses for environmental activities and certificates for technical means of monitoring the state of the environment.

1.7. Investigations of the state of the environment, calculations and modeling of environmental processes should be carried out on the basis of methods and techniques certified by the bodies of the Ministry of Natural Resources of the Russian Federation and the State Sanitary and Epidemiological Supervision of the Russian Federation.

1.8. The terms of reference for the development of the "Environment Protection" section are drawn up by the customer of the project and the general designer (in accordance with the stage of urban planning) and approved by the customer.

1.9. The customer provides initial data for the development of the "EP" section, assists in conducting surveys, analytical, survey and design work, and also participates in the approval of project documentation.

1.10. Development of sections "Environmental Protection" as part of urban planning documentation, not specified in clause 1.4. The Instructions are carried out taking into account the main requirements of urban planning standards and this Instruction, which provide a unified system of interrelated design documents, providing for the mandatory consideration of previously approved project documentation in the development of subsequent ones, and the sufficiency of the environmental justification of design decisions. The section "Environmental Protection" is developed taking into account the forecasts of the resource potential and is agreed with the state bodies of control and supervision.

Additional requirements for the composition and design of the project may be established by specially authorized bodies in the field of urban planning, environmental and sanitary and epidemiological control when developing design conditions and drawing up terms of reference.

1.11. Graphic materials for sections 2-12 of the Instruction are given in section 13 (subsections 13.2-13.12 respectively).

2. Master plan of the city

2.1. Physical and geographical characteristics of the city.

2.1.1. Climate. Assessment of meteorological conditions in various areas of the city (physiological and hygienic characteristics, radiation balance, insolation, wind regime, inversions, assessment of the meteorological potential of atmospheric pollution (APA), weather formation processes and meteorological zones with different conditions for the dispersion of pollutant impurities).

2.1.2. Geological structure and relief.

Geological and lithological features of the territory, engineering-geological processes and phenomena.

2.1.3. Hydrogeological conditions of the territory.

2.1.4. Water objects (reservoirs, rivers, lakes, ponds, small reservoirs).

2.1.7. Urban green spaces (parks, gardens, squares, boulevards, cemeteries, indoor gardening, etc.).

2.2. Assessment of the current state of the environment.

2.2.1. Ecological and sanitary-hygienic analysis of the functional use of the territory and the balance of the territory (the ratio of built-up, open and green areas, the share of recreational areas, environmental protection areas, etc.).

2.2.2. Zones of sanitary protection and buffer zones of historical and cultural objects, specially protected natural areas. their boundaries.

2.2.3. Component-by-component assessment of the state of the environment.

2.2.3.1. Atmospheric air:

analysis of background air pollution (according to the data of the OERS MosTsGMS Goskomgidromet of the Russian Federation);

identification of the main objects - pollution sources that form the fields of excess pollution, their characteristics and ranking according to their contribution to atmospheric air pollution in the city and according to the sequence of events;

assessment of the geological and lithological structure, soil stability, engineering and geological processes, engineering and construction assessment of the territory;

zoning of the territory according to the degree of complexity of engineering and construction conditions for development and exposure to adverse geological and engineering-geological processes and phenomena.

2.2.3.3. Hydrogeological characteristics of the territory:

depth of groundwater;

thickness and depth of occurrence of aquifers, hydrogeological parameters of aquifers;

thickness and consistency of the regional aquiclude.

2.2.3.4. Water objects:

sanitary-hygienic and ecological characteristics of water bodies;

Every citizen of the Russian Federation, in accordance with the current Constitution, has the right to live in favorable environmental conditions. The implementation of this right occurs through the environmental legislation of the Russian Federation. In accordance with this list of laws, not a single object of capital construction and the industrial sector can be implemented without the development of special design documentation.

The most important section of the project documentation, without which the project will not be approved, is the "List of measures for environmental protection", which is abbreviated as the PM EP or EP.

What is an OOS section?

The environmental protection section is a special part of project documentation drawn up for the construction and reconstruction of buildings for various purposes, which describes the impact of the facility on the environmental well-being of the region. The Environmental Protection Agency also develops a set of measures to reduce the negative impact on the environment, if any. This section is drawn up at the stage of development of project documentation for construction or reconstruction and is subject to subsequent environmental impact assessment.

In the process of developing the environmental protection section, specialists should be guided by the provisions of the Urban Planning Code and Art. 34 Federal Law No. 7 "On Environmental Protection". Without a well-compiled list of environmental protection measures, it is impossible to coordinate a capital construction and reconstruction project with the authorities.

Who needs to write an OOS section?

According to the legislation (Article 48, Clause 1 of the Town Planning Code of the Russian Federation), the development of a list of environmental protection measures is necessary in such cases:

  • in the process of construction and reconstruction of capital construction facilities located on land plots owned by the developer;
  • when carrying out a major overhaul of capital construction projects, in cases where the ongoing work affects important elements of the building structure.

At the same time, the law clearly indicates that the development of an environmental protection section in the process of construction, reconstruction and overhaul of residential buildings with less than three floors is not a prerequisite for project approval.

Penalties and liability

Failure to comply with environmental legislation in the process of developing project documentation entails administrative liability for the violator. If, as a result of non-compliance with environmental legislation, there is a threat to life or health of people, Article 262 of the Criminal Code of the Russian Federation may be applied, which implies up to two years in prison.

After the calculation of emissions of pollutants into the atmospheric air from the designed facility, in the environmental protection section, the calculation of the dispersion of pollutants in the surface layer of the atmosphere is carried out. The dispersion calculation is carried out on the basis of OND-86 "Methodology for calculating the concentrations in the atmospheric air of harmful substances contained in the emissions of enterprises", Leningrad Gidrometeoizdat 1997. It is the dispersion calculation that determines the degree of chemical pollution of the environment after the commissioning of the designed facility and, accordingly, the impact on health person. In the event that the calculation of dispersion reveals exceeding the standards for maximum permissible concentrations of pollutants, design solutions provide for environmental protection measures such as the installation of gas cleaning equipment (cyclones, filters), increasing the height of chimneys, etc.

If the project provides for the installation of noisy equipment at the enterprise, the impact of which on the health of the population of the area where the facility is located may be dangerous, the noise calculation is carried out in the environmental protection section. Calculation of noise impact from the projected object is carried out in accordance with TKP 45-2.04-154-2009 (02250) “Protection from noise. Building design standards. "Noise at workplaces, in vehicles, in the premises of residential, public buildings and in residential areas." In the event that the noise calculation showed that the norms of noise levels were exceeded, noise protection measures should be provided for in the design documentation.

The subsection “Protection of surface and ground waters from pollution and depletion” is carried out taking into account the requirements of the “Water Code of the Republic of Belarus” No. 149-З of 04/30/2014. This subsection reflects all the basic information about the organization of water supply and sanitation at the enterprise, as well as the availability of treatment facilities.

The subsection "Protection and rational use of land resources" is carried out taking into account the requirements of the "Code of the Republic of Belarus on Land" No. 425-3 dated July 23, 2008. This section reflects information on the volume of removed fertile soil, as well as ways to use it (for example, landscaping a projected object and (or) landscaping nearby territories).

The subsection "Protection of vegetation" is carried out taking into account the requirements of the Law of the Republic of Belarus No. 205-3 dated 14.06.2003. "On the Plant World". If the project provides for the removal or transplantation of flora objects (trees, shrubs, lawns) within the boundaries of the settlement, it is necessary to provide compensatory plantings in accordance with the Decree of the Council of Ministers of the Republic of Belarus No. 1426 of 10/25/2011. "On some issues of handling flora objects" as amended by Decree No. 458 of 06/14/2016. When felling tree plantations on the lands of the forest fund, the Decree of the President of the Republic of Belarus No. 1/8576 of 11.05.2007 is applied. “On some measures to improve activities in the field of forestry”.

The subsection "Protection of wildlife" is carried out taking into account the requirements of the Law of the Republic of Belarus "On wildlife". This subsection is developed only in case of damage to the animal world during the implementation of design solutions.

The subsection "Protection of the environment from pollution by production waste, municipal and municipal solid waste" is carried out taking into account the requirements of the Law of the Republic of Belarus No. 271-3 of 20.07.2007. "On Waste Management". This subsection contains information on both construction waste (generated during construction work) and production waste (which will be generated after the commissioning of the facility being designed).

The high-quality development of the environmental protection section is not only a guarantee for the successful and safe operation of an industrial enterprise, but also helps to eliminate possible problems with the bodies of the Ministry of Natural Resources, the Ministry of Health and residents of nearby settlements. Ecologists of ODO "ENEKA" will help in the development of the environmental section of the project documentation in accordance with all the requirements of the legislation of the Republic of Belarus.
